Solace Senior Advisors — Advisor Disclosure & Service Agreement
This disclosure constitutes an agreement between the Client (and/or the Client's family) and Solace Senior Advisors ("Service Provider"). By signing below, both parties agree to the following terms and conditions:
1. Scope of Services
The Service Provider will:
— Schedule tours for communities chosen by the Client and, where possible, accompany the Client on these tours.
— Continue to work with the Client until a community is chosen, or until such time as either party (Client, Client's family, or Service Provider) decides to terminate the engagement. Written notice is required to document the termination of services.
— All referrals sent during this contract engagement period by Solace Senior Advisors will remain viable for Solace Senior Advisors for up to one (1) year from the time of written termination notice receipt.
— If direct payment is required for any reason, the Service Provider shall inform the Client prior to engaging with a community.
2. Independent Contractor Status
The Client acknowledges that the Service Provider functions as an Independent Contractor and is not employed by any of the communities provided in the Community Fact Sheet or otherwise.
3. Impartiality & Referral Compensation
The Service Provider is not incentivized by referral rates or commissions from any one specific community. Community options provided to the Client and family are chosen solely based on the information the Client or family has provided regarding healthcare needs, geographic preferences, and financial considerations. The Service Provider maintains impartiality in recommending communities and selects options that align with the Client's best interests.
4. Client Decision Authority & Outcomes
The final decision regarding moving the Client into any community is entirely up to the Client and/or their family. The Service Provider will advise and provide information to assist in the decision-making process, but the responsibility for the final choice rests with the Client or their family. The Service Provider is not responsible for any actions, incidents, or outcomes related to the Client's selection of a community.
5. Confidentiality & Medical Information
The Service Provider agrees to maintain confidentiality with respect to all personal and sensitive information shared by the Client during this engagement. The Client's information will not be shared with any third parties without the Client's written or verbal consent, except as required by law.
By signing this document, the Client and/or their family agree to allow relevant medical information to be shared with community staff as necessary to determine the Client's eligibility and ensure that the chosen community can appropriately support the Client's needs.
6. Limitation of Liability
The Service Provider will not be held liable for any community's involvement in claims, lawsuits, or inspections that may be listed on any licensing or inspection reports. The Service Provider's role is limited to providing information and scheduling tours.
The Service Provider will provide services to the best of their ability and based on the most current information available. However, the Service Provider is not liable for any changes in community pricing, availability, or amenities that may occur after providing the information. The Service Provider is also not responsible for investigating any claims, lawsuits, or inspections regarding the community. As an Independent Contractor, the Service Provider is not liable for any legal, operational, or service-related issues arising from the community selected by the Client.
7. Privacy
Personal information provided — including names, contact details, care needs, and budget — will only be used by Solace Senior Advisors for placement advisory purposes. We do not sell, rent, or share your personal information with any third party without your explicit consent.
